Regulations for the sale of online courses

§1. General Information

  1. These Terms and Conditions specify the rules for the sale and use of online courses offered by:

  2. The Seller runs a sole proprietorship and benefits from a VAT exemption (flat-rate tax).
  3. The Terms and Conditions are available free of charge on the Seller’s website.

§2. Definitions

  1. Seller – Joanna Banasiak Yoga.
  2. Client – a natural person purchasing an online course.
  3. Product – digital content in the form of online courses (video recordings, audio, PDF files).
  4. Agreement – an agreement for the supply of digital content concluded between the Seller and the Client.

§3. Nature and Scope of Products

  1. The products offered by the Seller are digital content not delivered on a tangible medium.
  2. Access to the course is granted after the payment has been successfully credited.
  3. Information regarding the duration of access to the course is provided in the description of the specific product.
  4. Upon the successful booking of the payment to the Seller’s account, the Client gains access to the purchased course within their user account.
  5. Access to the course is granted automatically and realized by logging into the user account on the Seller’s platform.
  6. The Client receives access to the course content for personal use only. It is prohibited to share the account, login, or course content with third parties, unless the Terms and Conditions or a separate agreement state otherwise.

§4. Purchase Conditions

  1. The purchase of a Product occurs by placing an order on the website.
  2. Product prices are final prices.
  3. The Seller benefits from a VAT exemption.
  4. The Client is obliged to provide true data necessary for the fulfillment of the order.
  5. A condition for purchasing a course is creating an individual user account on the Seller’s platform by filling out the registration form and accepting these Terms and Conditions.

§5. Right of Withdrawal

  1. Pursuant to Article 38, point 13 of the Act on Consumer Rights, the Client is not entitled to the right of withdrawal from the agreement if:
    • they have consented to the delivery of digital content before the expiry of the 14-day period,
    • they have been informed about the loss of the right of withdrawal.
  2. Placing an order constitutes acceptance of the above conditions.

§6. Health and Safety Clause

  1. Online courses are educational in nature and do not constitute medical, physiotherapeutic, or therapeutic advice.
  2. Before starting exercises, it is recommended to consult a doctor or physiotherapist, particularly in cases of:
    • pregnancy,
    • postpartum period,
    • injuries,
    • chronic diseases.
  3. The Client performs exercises at their own risk, in accordance with their own capabilities and state of health.
  4. In case of pain, discomfort, or feeling unwell, exercises should be stopped immediately.
  5. The Seller is not liable for any injuries or damages resulting from incorrect use of the courses.

§7. Copyright

  1. All materials provided as part of the courses constitute the intellectual property of the Seller.
  2. It is prohibited to copy, distribute, share with third parties, or use the materials for commercial purposes without the Seller’s consent.

§8. Complaints

  1. Complaints regarding Products should be submitted via email to: asiamalek@aol.com.
  2. Complaints are considered within 14 days from the date of their receipt.

§9. Final Provisions

  1. The Terms and Conditions are effective from the date of publication on the website.
  2. The Seller reserves the right to make changes to the Terms and Conditions.
